Rule 5: Trial

Section 1. Witnesses
-only persons whose affidavits were submitted
may be presented as witnesses, except :
1) testimony of adverse hostile witness
2)If failure to submit evidence is for meritorious and
compelling reasons
3) Newly discovered evidence
-the affidavits of the witnesses shall serve as
their direct testimonies, subject to cross
examination in accordance with existing rules of
evidence
Section 2. Trial schedule
-not later than 30 days from the
date of the pre-trial order
-hearings completed not more than
60 days from date of initial hearing
-failure to present witness is deemed
a waiver
Section 3. Written offer of evidence
-not later than 5 days from the
completion of the presentation of the
evidence from the parties concerned
-the opposing party shall have 5 days
from receipt of the offer to file
comments or objections
-ruling o the offer is within 5 days from
the expiration to file comments
Section 4. Memoranda
-filed within 30 days from receipt of
order
-contents:
1. statement of the case
2. statement of the facts
3. statement of the issues
4. arguments
5. relief
-no reply memorandum allowed
Section 5. Decision after trial
-not later than 90 days from the
lapse of the period to file a
memoranda, with or without said
pleading having filed
