The complaint shall be in writing
in the name of the Bureau of Jail
Management and Penology
represented by the Prosecutor and
against all personnel who appear to be
responsible for the offense involved.

FORMAL CHARGE
1. Documentary Evidence:
Other material evidence that may arise during the course of the trial.
2. Witnesses:
Other witnesses that may arise during the course of the trial.
The Complaint shall be filed in three (3)
copies directly with the respective BJMP
Regional Hearing Office or with the BJMP
National Headquarters Hearing Office
pursuant to Section 2, Rule II of the BJMP
Administrative Disciplinary Machinery.
Simultaneous to its filing, one (1) copy shall
be furnished to the Office of the Legal
Service, National Headquarters.
The Director, Directorate for
Investigation and Prosecution, Chief,
Regional Investigation and Prosecution
Division, or Prosecutor is authorized to
file the Formal Charge.
The Complaint shall contain a
specification of the charge, a statement of
ultimate facts, accompanied by certified
true copies of the documentary evidence, if
any, and sworn statements covering the
testimony of witnesses. A complaint
alleging a generic or unspecified offense
may be dismissed without prejudice to re-
filing.
A Complaint shall contain only
but one charge.
