Background To The Maritime Labour

Convention 2006, And Maritime Context.


Seafarers
It is estimate that about 1000 ships and crews- i.e. around 15000
seafarers and fishers- may have been abandoned between 1990 qnd
2006.

Since 1999, the IMO and ILO have been working jointly to find a
binding solution to the problem of abandonment of seafarers by their
employers, as well as to that of compensation for seafarers injury and
death.

Full implementation of following principles for
every seafarer:
Safe & secure workplace that complies with
safety standards
Fair terms of employment
Decent working & living conditions
Health protection, medical care, welfare
measures & social protection
Overall objectives of the MLC, 2006
To establish decent working and living conditions for all
seafarers
To ensure commitment from governments and ship owners
To put control and enforcement mechanisms in place to ensure
there is a level playing field.
Protection against unfair competition from substandard ship
Eradicate poor working and living conditions
Attract, recruit, develop, motivate and retain qualified labour
1. Minimum Requirements For Seafarers
To Work On A Ship

Minimum age 18 years

Valid Medical Certificate in English language

Seafarers with certificate of qualification only

Not seafarer should have to pay a placement fee!


2. Conditions Of Employment
All seafarers should receive a signed contract.

Payment of the full wages should be carried out regularly in an


interval no more than one month.

Working hours:
- not more than 14 hrs in 24 hrs and 72 hrs in 7 days.

Rest:
- Not less than 10 hrs in 24 hrs and 77 hrs in 7 days
- If possible trainings should not interrupt hours of rest.
- Hours of rest a seafarer missed out on in case of emergency
has to be compensated.
3. Accommodation, Recreational Facilities,
Food And Catering.
Accommodation + recreational facilities must be complied with the
actual MLC standards.
Inspections of accommodation on no more than monthly intervals,
records must be kept 3 years.
No costs for any crew member for food or drinking water.
Person processing food shall be trained + instructed in food and
personal hygiene.
Needed equipment for preparation of meals in hygienic should be
provided on board.
Weekly inspections + records (to be kept 2 years).
4. Health Protection, Medical Care. Welfare
And Social Security Protection
Whenever and wherever possible crew members shall be able to visit a
doctor on no costs-medical report by master.
For ship-owners liabilities please check your valid crew employment
agreement
Company Safety Management Manual includes Procedures, emergency
plans and operation forms- information and tools provided on board.
In compliance with on board duties each seafarer should have the
opportunity to access shore based facilities.
5. Compliance And Enforcement

Procedure.
