REPUBLIC ACT No.

10932
AN ACT STRENGTHENING
THE ANTI- HOSPITAL
DEPOSIT LAW
President Rodrigo Roa Duterte on Thursday,
August 3, signed into law, increasing the
penalties for the refusal of hospitals and
clinics to administer appropriate initial
medical treatment in emergency or serious
cases.
provides that in emergency or serious cases,
it shall be unlawful for any hospital or medical
clinic to request, solicit, demand or accept any
deposit or any other form of advance payment
as prerequisite for administering basic
emergency care, for confinement or medical
treatment, or to refuse to administer medical
treatment and support to any patient.
Penalties
Under this new law, any official, medical
practitioner or employee of the hospital or medical
clinic who violates the provisions of this Act shall be
punished by imprisonment of not less than six (6)
months and one (1) day but not more than two (2)
years and four (4) months, or a fine of not less than
P100,000.00 but not more than P300,000.00 or both.
Higher penalties of imprisonment of four (4) to six
(6) years, or a fine of not less than P500,000.00 but
not more than one million pesos, or both, are
imposed upon directors or officers of hospitals or
clinics responsible for the formulation and
implementation of policies or instructions violative
of this Act.
Penalties

10932, shall result in the revocation of the
health facilitys license to operate by the
Department of Health (DOH).
ALL HEALTH facilities,
whether government-owned or
private, are prohibited from
refusing persons seeking medical
help or from detaining them for
nonpayment of hospital bills or
medical expenses.

I have seen how cruel these private
hospitals/clinics are. My pal Jhun crashed his
motorbike, dislocating his left arm. The Polyclinic
did nothing for 12 hours. We transferred him to
PGH. His severed limb I was holding was already

make arrangements with the hospital before
confinement? Private hospitals detain patients, but
not Fabella Hospital. It may be free but be ready to
accept, absorb and abide by the law of the irritated

Hustisya ang hiling ng isang ginang para sa kaniyang


16-anyos na anak na namatay matapos magsilang sa
isang pagamutan sa Cavite. Naging komplikado ang
kalagayan ng dalagita nang maiwan sa sinapupunan nito
ang inunan ng kaniyang isinilang sanggol. namatay ang
kaniyang anak dahil sa kapabayaan umano ng ospital na
una nilang pinagdalhan sa anak, at sa pagtanggi naman
ng dalawa pang ospital na tanggapin kaagad ang
kaniyang anak nang ilipat nila ito dahil hiningan daw
muna sila ng pera. . Inilipat umano sa Imus Family
Hospital ang pasyente pero hindi raw tinanggap doon
dahil kailangan daw munang magbayad ng pamilya ng
P10,000.00. Dahil dito, inilipat at dinala naman ang
dalagita sa Medical Center Imus o MCI na humihingi
naman daw sa pamilya ng P20,000.00 deposito bago i-
admit ang pasyente. Inasikaso lang daw ng MCI ang
pasyante nang makitang naghihingalo na ito, at doon na
binawian din ng buhay ang dalagita.
ADVANTAGE/S
The poor don't need to beg for medical
care.
This law is a reflection of this duty and of
our continued commitment to improve and
provide sufficient health care to the sectors
of society that need it the most. People who
need emergency medical care can now be
assured of stronger rights under the law.
The new law protecting impoverished
hospital patients gives a refreshing note in
favor of human rights.
DISADVANTAGE/S
It will be abused by those who really dont want to
pay, for all they have do is promise to pay. But what
or who guarantees payment? Private hospitals will

place, private hospitals are not a place for those who

The Law will be subject to abuse some


private hospitals.
Patients may use this law not to deposit
