CICL SITUATION PRIOR TO RA 9344

 From 1995 to 2000, a total of 52,576 children were in


detention or under custodial setting

 An average of 10,515 children were being arrested ever year


– about 28 children/day, or more than 1 child/hour

 Few cases were being resolved


- i.e. Only 29% of 11,812 CICL cases handled by PAO in 2004
were resolved

 21 children have been given capital punishment by 2004

• BJMP reported that majority of jails all over the country do


not have a separate detention facilities for children

• Food budget for detained children is Php 35/day

• Many of them suffered from different kinds of abuses


especially under custody or detention including sexual,
psychological, and physical abuse; rape; torture; cruel
treatment

• Adult-oriented system – the age and distinct circumstances


of CICL are not taken into account

• No diversion -- children can be detained even for petty and


light offenses

• Perpetuated the stigma of criminality because children as


young as 9 years old can be detained and tried even for
petty crimes and status offences (i.e. curfew)

• Children became vulnerable to all kinds of abuses during


arrest and detention

• Gestation period of around 13 years before it was finally


enacted
• It is a landmark child protection law that seeks to remedy the
significant problems of the plight of children in conflict with
the law in the Philippines
• The dire conditions of children in the Philippines has attracted
national and international attention
• Many agreed that jail is no place for children
• The Philippines passed the law in 2006

• Aims to prevent children to offend/reoffend

• Seeks to rehabilitate and reintegrate them as useful citizens


of the society

• Treats CICL according to age and evolving capacity

• Concerned not only with CICL but all children


- Through the structures and programs required at national and
local level it seeks to establish a protective environment for
children so that they will not commit crimes or be victims of crimes
ESTABLISHMENT OF JJWC

• RA 9344 provides for the establishment of the Juvenile Justice


and Welfare Council (JJWC).

• Attached to Department of Justice and Chaired by


Department of Social Welfare and Development

• 7 NGAs and 2 NGO representatives

• JJWC National Secretariat; 10 plantilla positions

Congresswoman Kate Gordon
In 1993 then Congresswoman Kate Gordon filed the
HB 7482 entitled “An Act Establishing a Comprehensive
Juvenile Justice System and Appropriating Funds
Therefore”. It was endorsed by 23 members but remained at
the committee level.
May 20, 2006

Both Houses of Congress unanimously ratified the Juvenile


Justice and Welfare Act of 2006 on March 22, 2006.
President Gloria Macapagal- Arroyo signed it into law last
April 28, 2006 while the ceremonial signing followed on
May 16, 2006. The law took effect May 20, 2006.
