The Four Rights of Fair Housing
The principles of fair housing can be explained through the following four core rights:

The Right to Choose


The promise of individual and family mobility, integration and choice of where to live for all
protected classes. Government housing dollars must be used to further access to and habitation
in high opportunity areas.

The Right to Stay


Prevents the involuntary displacement of low income people of color through gentrification.
The government must aid low income neighborhoods in becoming high opportunity areas.

The Right to Equal Treatment


Public services and facilities, along with certain regulated private services such as access to
mortgage credit and housing, are provided equitably in all neighborhoods, regardless of
prevailing class or race in the neighborhood.

The Right to Have a Say


Government permits all people, especially low income people of color, meaningful democratic
participation in the decisions that affect their families and neighborhoods.

“An Ordinance prescribing that portion of the City of Lubbock within which
negroes and persons of African descent, containing as much as one-eighth negro
blood, shall reside, except bona fide servants residing on the place where
employed; forbidding persons to sell property outside of such district to negroes
or persons containing as much as one eighth negro blood; forbidding the rental of
property outside such district to persons containing as much as one-eighth negro
blood, providing penalties and declaring an emergency account of
negroes living in other districts and causing danger to
health and pollution of the atmosphere. Be it ordained by
the City Council [Commission] of the City of Lubbock,
Texas.

Section 1. Nonegro or persons of African descent or


containing as much as one-eighth negro blood shall own
property or reside thereon in any part of this city except
that part lying South of 16th St. and East of Avenue C, and

significant number (at least 500 people) or share of
the population (at least 33%) live more than 1 mile
from a full service grocery store. A tract is low
income if: the poverty rate is at least 20%; the MFI is
less than or equal to 80% of the state MFI; or the
MFI is less than or equal to the metro area’s MFI.
