What are the ethics of
moonlighting?
 The first is what circumstances lead to the phenomenon
of moonlighting in the first place, and whether there is
any just way for companies to limit the off-work activities
of people when they are not being paid by the company
for that time.

 The second is what sort of ethical dilemmas can easily


result from moonlighting, giving the example of a fellow
named Emil Korner.

 PENALTIES Rule 10 SCHEDULE OF PENALTIES

 Section 46. Classification of Offenses. –


Administrative offenses with corresponding penalties
are classified into grave, less grave or light,
depending on their gravity or depravity and effects
on the government service.

 Revised rule and procedure before the
Administrative Disciplinary Authorities and Internal
Affair Service of Philippine National Police.

 Pursuant to Republic Act No. 6975 otherwise known


as the Department of Interior and local government
act of 1990 as amended by the Republic Act No.
8551 otherwise know as Philippine National Police
Reform and Reorganization Act of 1998 the
provision of Napolcom Memorandum circular No.
2007-001 are hereby prescribe and promulgated.
RULES 1

 Section 1. title - these Rule shall be known and cited


as the Revised Rule of procedure before the
administrative Disciplinary Authorities and internal
Affair Service of the Philippine National Police.

 Section 2. Scope and Application – These Rule shall


apply to all administrative case against uniformed
members of Philippine National Police (PNP) Before
the different Disciplinary Authorities and the Internal
Affair Service

PENALTIES OF RULE 21

 Section 2. Classification of offense – for purposes of


determining jurisdiction and applying appropriate
penalty, administrative offenses are classified into
light, less grave and grave.
B. Grave Misconduct

 Sec. 2. Grave Irregularities in the Performance of


Duty – shall include but no be limited to the following.

 a.) Act as bodyguard or security guard for any


elective public office or position or any other person
within three months immediately preceding any
election and within one month (1) thereafter, without
authority from the commission on election.
 b.) Act as bodyguard or security guard for the
person or property of any public official or private
person unless approve by the proper authorities.

 c.) Reveal Secret or confidential Police matters and


information which jeopardize police mission and
operation or which cause injury and damage to
citizen.

 d.) Unauthorized establishment of checkpoint in any


public thoroughfare for the purpose of stopping or
searching vehicles or person or if authorized dose
not comply with the rules set by the PNP.
 e.) Unauthorized escorting of any vehicles
carrying highly capable dutiable or taxable
goods, merchandised, appliance and machinery.

 f.) Failure to turn over to the police station within


a reasonable period any apprehended or
arrested person.

 g.) Countermand any lawful order of the mayor,


chief of police of his superior officer
 h.) Perform the duties and function of custom or
immigration authorities without proper deputation in
accordance with the law.

 i.) Escort or allow other members to escort detention


prisoner outside the jail in order to attend a funeral,
visit sick relative or solicit a bond without order of the
court of proper jurisdiction.
PENALTIES OF OFFENSE

 Sec 1.) Imposable Penalties – the following are the


penalties that may imposed in police administrative
cases.
a.) Reprimand
b.) Withholding privilege
c.) Restriction to specified limit
d.) Restricted Custody
e.) Forfeited of Salary
f.) Suspension

Grave offenses

 a.) Sixty Days (60) to six (6) month suspension


(minimum)
 b.) One (1) Rank Demotion (medium)
 c.) Dismissal from the service (maximum)

 Sec. 3.) Limitation in the imposition of penalties in


case of forfeiture of salary the amount shall not
exceed the equivalent of one (1) month salary.
B. Less Grave Misconduct

 Sec. 3.) Less Grave Misconduct – shall include but


not limited to the following.

 a.) Take advantage of his position by procuring


goods and commodities at a losing price to unwilling
seller, or partake of food, drinks and cigarette free of
charge.

 b.) Engage in regulated Gambling or game chance,


while on duty.
 c.) Be drunk and disorderly while on or off
duty and recognizable Police Uniform.
 d.) Maliciously intrigue against the honor of a
co-officer , or indulge in idle gossip or spread
rumors that tend discredit of PNP member.
 e.) Exhibit marked discourtesy in the course
official duties or use profane or insulting
language to any superior officer.
 f.) Serve an escort or security officer, whether on foot
or by motor vehicle, for any private individual
regardless of his status in social or religious circles
on any occasion, unless authorized by the Chief of
Police or the appropriate official authorized to do so.

 g.) take to trip abroad without approval of the


authorities concerned.

 h.) Barrow or solicit money or valuable from his


subordinates unless the latter is engaged in lending
company.
 i.) Commit any act or omission that constitutes a
crime punishable under the Revised Penal Code or
special law where the duration of the imposable
penalty is imprisonment of one (1) month and one (1)
day and six (6) months.


Rule 22
Penalties
 Section 2.) Range of Penalties – the penalties for light
and less grave and grave offenses shall be made
accordance with the following ranges.

 Less Grave Misconduct

 a.) Withholding of privileged : Restriction to specified


limits, restrictive custody: suspension or forfeiture of
salary or any combination thereof from thirty one (31)
days to forty (40) days ( minimum):
 b.) Withholding of privileged Restriction to specified
limits, restrictive custody: suspension or forfeiture of
salary or any combination thereof from Fifty one (51)
days to fifty nine (59) days (maximum
