What’s the Situation?

➔ Marketing company offers a web service that allows customers to receive


professional advice from various disciplines
➔ The company pays the professionals for the qualified advice they provide
➔ Is it ethical for you, a structural engineer, to provide advice for a little extra
money? What are your options?
Our Analysis

Canon 5

➔ “Fire protection engineers shall perform professional services only in the areas
of their competence and after full disclosure of their pertinent qualifications.
They shall not falsify or permit misrepresentation of their academic or
professional qualifications or experience.”
Canon 10

➔ “Fire protection engineers shall not accept compensation from more than one
party for services on the same project, or for services pertaining to the same
project, unless the circumstances are fully disclosed to and agreed to, by all
interested parties.”
NSPE Rules of Practice

➔ “Engineers shall not permit the use of their name or associate in business
ventures with any person or firm that they believe is engaged in fraudulent or
dishonest enterprise.”
➔ “Engineers may express publicly technical opinions that are founded upon
knowledge of the facts and competence in the subject matter.”
➔ “Engineers shall issue no statements, criticisms, or arguments on technical
matters that are inspired or paid for by interested parties…”
➔ “Engineers shall not solicit or accept financial or other valuable consideration,
directly or indirectly, from outside agents in connection with the work for
which they are responsible.”
NSPE Professional Obligations

➔ “Engineers shall not accept outside employment to the detriment of their


regular work or interest. Before accepting any outside engineering
employment, they will notify their employers.”
➔ “Engineers shall not, without the consent of all interested parties, participate
in or represent an adversary interest in connection with a specific project or
proceeding in which the engineer has gained particular specialized knowledge
on behalf of a former client or employer.”
➔ “Engineers shall, whenever possible, name the person or persons who may be
individually responsible for designs, inventions, writings, or other
accomplishments.”
Final Recommendation

➔ The credibility comes into question especially providing answers through a web
portal, the professional advice given is not factually checked by another
qualified individual
➔ The customers receiving the professional advice needs to be able to consult
back to the qualified individuals to make sure reduce the chances of
miscommunication (e.g Jargons, technical logic behind the advice)
➔ In conclusion, Engineer A should not partake in this type of business
