Sec 2: Visit and Search of Merchant Vessels

Sec 3: Interception, Visit and Search of Civil Aircraft

proceed for visit and search to a belligerent airfield that is safe

• Vessels engaged in environment protection

• Capture of a merchant vessel is exercised by taking such vessel as prize for
adjudication. Diversion remains as alternative option.

• Destruction of en passenger vessels carrying only civilian passengers is

• The following vessels are exempt from capture (subj to innocent employment):

• Aircrafts granted safe conduct by agreement

• Capture is exercised by intercepting the enemy civil aircraft, ordering it to


proceed to a belligerent airfield that is safe.

• As an alternative to capture, an enemy civil aircraft may be diverted from its
declared destination.

effects must be provided for.

• Contraband is defined as goods which are ultimately destined for

territory under the control of the enemy and which may be susceptible for
use in armed conflict.

belligerent's contraband list are 'free goods‘.

• Every effort should be made to avoid destruction of a captured neutral

a zone in a defined area of the sea in which only activities consistent with
those humanitarian purposes are permitted

Nationals of a Neutral State

166 • Whoare passengers on board en or neutral vessels or ac are to be released


and may not be made POW unless they are members of the en armed forces or
have personally committed acts of hostility against the captor

• Members of the crew of en warships or aux vessels or mil ac or aux ac are


entitled to POW status and may be made POW

• crew
of en or neutral merchant vessels or civil ac are to be released & may not
be made POW unless the vessel or ac has committed an act of hostility

Section 2: Med Tpt

169 • To provide max protection for hospital ships from the moment of the
outbreak of hostilities, States may beforehand make general notification of
the characteristics of their hospital ships. Such notification should include
all aval info on the means whereby the ship may be identified

• Hospitalships may be eqpt with purely deflective means of defence, such
as chaff and flares. The presence of such eqpt should be notified

174 • Med ac shall be protected and respected as specified in the provisions of

crescent, together with their national colours, on their lower, upper and
lateral surfaces

agreement

• When within neutral airspace pursuant to agreement, med ac shall comply


with the terms of the agreement which may require the ac to land for
inspection at a desig airport within the neutral State

• Should a med ac, in the absence of an agreement or in deviation from the


terms of an agreement, enter neutral airspace, either through nav error or
because of an emg affecting the safety of the flight, it shall make every
effort to give notice and to identify itself

• Once the ac is recognized as a med ac by the neutral State, it shall not be


attacked but may be req to land for inspection

• Once it has been inspected, and if it is determined in fact to be a med ac,


it shall be allowed to resume its flight

the inspection reveals that the ac is not a med ac, it may be captr, and
the occupants shall, unless agreed otherwise between the neutral State
and the parties to the conflict, be detained in the neutral State where so
required by the rules of intl law applicable in armed conflict, in such a
manner that they cannot again take part in the hostilities
