The person does not transgress the law, does not commit any
crime because there is nothing unlawful in the act as well as
the intention of the actor
EXEMPTING CIRCUMSTANCES
The exemption from punishment is based on the complete
absence of intelligence, freedom of action, or intent, or on
the absence of negligence on the part of the accused.
AGGRAVATING CIRCUMSTANCES
Those circumstances which raise the penalty for a crime without
exceeding the maximum applicable to that crime.
A child above fifteen (15) years but below eighteen (18) years
of age shall likewise be exempt from criminal liability and be
subjected to an intervention program, unless he/she has
acted with discernment, in which case, such child shall be
subjected to the appropriate proceedings in accordance with
this Act.
