Objectives

 This study intends to examine and scrutinize the crimes


defined under the Revised Forestry Code in connection
with penalties that accompany them in order for us to
ascertain whether such penalties are means for us to
reinforce efforts in the rehabilitation of our forest land.

 The study also aims to create practices that would bolster


that these offenders will abide with the rehabilitative
penalties.
STATEMENT OF THE PROBLEM
This paper aims to answer the following questions:

 Are the provisions of the Revised Forestry Code on Criminal


Offenses and Penalties aim to furnish the three-fold purpose
of penalty, such as: [1] Retribution; [2] Reformation; and [3]
Social Defense?

 Are the said provisions being followed in practice and


being imposed strictly against the transgressors of the law?
 Are the said provisions being monitored by the authorized
agency of the government, once imposed?

 Are the said penalties adhere to the policies of the


Revised Forestry Code, and simultaneously favor and
promote the preservation and development of the
Philippine Forestry?
METHODOLOGY
I. Theoretical Framework

A. Revised Forestry Code

As the prevailing law governing the utilization and


protection of the forest lands and its resources, It becomes
the basis of offenses and penalties that this research
intends to study as well as the authority and jurisdiction of
the Bureau of Forestry and the procedures in implementing
them.
B. Revised Master Plan for Forestry Development

In response to the continuously evolving issues affecting


forestry in the country, The Department of Environment
and Natural Resources formulated the Master Plan for
Forestry Development in which an action agenda was
proposed.

Such agenda also called for the Government and all


stakeholders to re-evaluate, revise and promote
adherence to MPFD considering other emerging issues in
forestry and the environment
II. Conceptual Framework

This study will examine the crimes and its penalties defined
in the Revised Forestry Code and illustrate its involvement in
the Revised Master Plan for Forestry Development in
order that such penalties may become an avenue for the
rehabilitation of the forest lands. This study will also examine
existing procedures in implementing such rehabilitation
efforts of the bureau, its feasibility and advocate or
recommend schemes to bolster the implementation.
SCOPE AND LIMITATION

 The results of the study will be reflective only to the state and
circumstances present within the sufficient information and
data to be outsourced from the Forest Management Bureau
of the Department of Environment and Natural Resources.

 Collection of data would be done through research of


available studies within the Department and consultation with
relevant administrative authorities.
 The researchers are only bound by the comments and
observations provided by the officers of the authorized
agency to be interviewed.

 the study will be bound to the particulars that may be


made available to the general public.
