• ARCHITECT ACT-1972 has four chapters and
45 sections.

CHAPTER-1
PRILIMINARY(S.1and 2)
• SECTION-1, DEALS SHORT TITLE , EXTENT AND
COMMENCEMENT
• 1(1). THIS ACT CALLED ARCHITECT -1972.
• 1(2). EXTENT ALL OVER INDIA
• 1(3). IT SHALL COME INTO FORCE ON SUCH
DATE THE CENTREL GOVT: PUBLISHED IN
OFFICIAL GAZETTE.
• SECTION-2,deals with definitions

• 2(a) ‘ARCHITECT’ means a person whose name


is time being entered in the register.
CHAPTER-II
COUNCIL OF ARCHITECTURE( S-3 to22)
• CHAPTER II DEALS WITH CONSTITUTION OF
COLUNCIL OF ARCHITECTURE.
• SECTION 3(1). CENTREL GOVT BY
NOTIFICATION CONSTITUTE A COUNCIL
KNOWN AS COUNCIL OF ARCHITECTURE,
WHICH SHALL BE A BODY CORPORATE,
HAVING PERPETUAL SUCCESSION AND A
COMMOM SEAL .
• SECTION -3(3) deals with the following persons.
• a. five members elected from Indian
institute of architects.
• b. two persons nominated by AICTE.
• C. five persons elected from HOD,s of
architectural colleges.
• d. chief architect’s of defense, railway
and central PWD as ex-officio members.
• e. one person nominated by central govt.
• f. an architect from each state nominated by that
state .
• g. Two persons nominated by Indian
institute of engineers.
• h. One person nominated by institution of

surveyors.
• Sections- 4, 5,6. President and vice president
of the council, mode of election, term of office
and causal vacancies.
• Section-9, meeting of the council- at least
once in every six months.
• Section -10, executive committee- president
and vice president as ex-officio with five
elected members among them.
• Section-12, office and other employees. The
council shall appoint a register who shall act
as secretary and also appoint other staff
members.
• Section-13 deals with finance of the council.
• Section-14 recognition of qualifications
granted by authorities in India.
• Section – 15 foreign qualifications.
• Section 16 – power of central Govt: to amend
schedule.
• Section -18. power to require information as to
courses of study and examinations.
• Section -19 inspection of examinations.
• Section – 20 withdrawal of recognition.
• Section – 21 minimum standard of architectural
education.
• Section -22 professional conduct. The Council may
by regulation prescribe standard of professional
conduct and etiquette and code of ethics for
architects.
CHAPTER-III(S.23 TO 35)
REGISTERATION OF ARCHITECTS.
• Section – 23 preparation and maintenance of
register.
• 1.central govt: prepared a register of Architect’s
in India.
• 2. Council duty to maintain the register.
• 3. the register shall include the following
particulars.
• a. full name with date of birth, nationality and
residential address of the architect.
• b. the qualification for registration and date of
which obtained, the authority which conferred it.
• c. date of his first admission to the register.
• d. his professional address.
• Section – 25 qualification for entry in register.
• a. hold a recognized qualification; or
• b. engaged in practice as an Architect for a period
of not less than five years prior to the date
appointed by central Govt. the date is 27-3-1974
vide notification 14-3-1974.
• c. other qualifications prescribed by the Rules.
• Section -26 . Procedure for subsequent
registration.
• 1. All application for registration shall be
addressed to Register of the Council .
• 3. if application for registration is rejected,
has a chance to appeal within three months of
period.
• 4. the Register shall issue a certificate of
registration.
COA REGISTERATION CERTIFICATE
• Section -27. 1.the registration is for 31st day of
December of the year. Renewal for registration is
before 1st day of April of the year.
• 2.if the renewal fees not paid before the due date,
remove the name from the register.
• Section – 28. entry of additional qualification.
• Section- 29. removal from registry.
• 1.a. request from Architect.
• 1.b. by death.
• 2.a. entry by error or misrepresentation.
• 2.c. He is an undischarged insolvent.
• 2.d. Declaration of combitant court as a unsound mind.
• Section -30. procedure in inquires relating to
misconduct.
• 1. when a complaint is received council may
hold an enquiry.
• 2.based on enquiry report, the council will be
heard the Architect, if found guilt - reprimand
the said Architect, or suspend from practice
as an Architect, or removal of his name from
the register.
• Section – 31. surrender of certificates, if name has removed
from the register the certificate of registration should be
surrendered to the registrar.

• Section – 32. restoration to registration, by sufficient


reasons subject to the approval of Central Govt: by paying
prescribed fees.

• Section – 33. issue of duplicate certificate, when the


certificate is lost or destroyed- duplicate certificate will be
issued by paying prescribed fees.
• Section – 34. printing of register, after 1st day
of April each year.

• Section -35. effect of registration. Expiry of


date of appointment (date of appointment of
central govt: is 27-4-1974 vide notification dt.
14.3.1974.). An Architect shall get preference
for appointment in Central/ State/ Local
bodies etc.
CHAPTER IV(S.36 TO 45)
MISCELLANEOUS
• Section – 36. penalty for falsely claiming to be
registered. He shall be punishable with fine of Rupees
one thousand .
• Section – 37.(1) prohibition against use of title. No
person other than a registered Architect or a firm of
Architect shall, use the title or style of Architect.
• (a). This section shall not apply to practice of
Landscape Architect and Navel Architect.
• (b)An Architect from outside the Country practice in
India with prior permission of Central Govt:
• Section – 37(2). Contrary to subsection-1, he shall be
punishable on first conviction for rupees five hundred
subsequent conviction, imprisonment for six months or with
fine of rupees one thousand or both.

• Section -38. failure of surrender of certificate of Registration. If


any person his name is removed from the register of Architect
forthwith to surrender his certificate of registration, fails
punishable a fine of Rupees one hundred , with further failure
an additional fine of Rupees ten rupees per day.

• Section – 39(1). Cognizance of offence, no court shall take


cognizance of any offence punishable under this Act, except any
compliant made by Council.
• (2). Magistrate of first class shall try any offence punishable
under this Act.
• Section -40. information to be furnished by
Council and publication thereof.

• Section -41. protection of action taken in


good faith.

• Section – 42. Members of Council and officers


and employees to be public servants.
• Section – 43. power to remove difficulties. The central
Govt: has power to remove difficulties within two years
period from the commencement of this Act.

• Section – 44. power of central Govt: to make rules. The


Central govt: by notification in the official gazette make
rules to Carrey out the propose of this Act.

• Section -45. power of council to make Regulations.


Council with the approval of central Govt by notification
in the official Gazette) may make regulations. The
regulations shall mot be inconsistent with the Act.
