PRESIDENTIAL DECREE # 1866
as amended by Republic Act 8294

 FIREARM includes rifles, muskets, carbines, shotguns,


revolvers, pistols and all deadly weapons from which bullet,
ball, shot, shell or other missile maybe discharged by
means of gunpowder or other explosives. The term also
include air rifles and air pistols not classified as toys under
the provisions of Executive Order No. 712

 Dated 28 July 1981.

 THE BARREL OF ANY FIREARM SHALL BE


CONSIDERED A
COMPLETE FIREARM.
PRESIDENTIAL DECREE NO. 1866 AS AMENDED BY REPUBLIC
ACT 8294 PENALIZE THE FOLLOWING ACTS:
 SECTION I - Unlawful manufacture, sale, acquisition, disposition
or possession of firearms, ammunition or instruments used or intended to
be used in the manufacture of firearms and/or ammunition.

 The penalty of 4 years and 1 day to 6 years imprisonment - LOW


POWERED firearm such as RIMFIRE HANDGUN, .380 or .32 and other
firearm of similar firepower provided that NO OTHER CRIME WAS
COMMITTED.

 The penalty of 6 years and 1 day to 8 years imprisonment and a fine of


Php 30,000.00 - HIGH POWERED firearm which includes those with bigger
in diameter by .38 caliber and 9 millimeter such as .40, .41, .45 and also
lesser caliber firearms but considered powerful such as caliber .357 and .
22 center-fire magnum and other firing capability of full automatic
provided that NO OTHER CRIME WAS COMMITTED.
 If homicide or murder is committed with the use of an
unlicensed firearm, such USE OF AN UNLICENSED FIREARM
SHALL BE CONSIDERED AS AN AGGRAVATING
CIRCUMSTANCES.

 If the violation of this section is in furtherance of, or


incident to, or in connection with the crime of rebellion,
insurrection, sedition or subversion or attempted coup d’
etat, such violation shall be ABSORBED of the crime of
rebellion, insurrection, subversion, sedition or attempted
coup d’ etat.

 The same penalty shall be imposed upon the owner,


president, manager, director or other responsible officer of
any public firm, company, corporation or entity who shall
willfully or knowingly allow any of the firearms owned by
such firm, company, corporation or entity to be used by
any person or persons found guilty of violating this section
or willfully or knowingly allow any of them to use
unlicensed firearm or firearms without any legal authority
to be carried outside of their residence in the course of
their employment.
 The penalty of Arresto Mayor (1 month and 1 day to
6 months imprisonment) for carrying of firearm
outside residence without proper authority.

 Section 3 - Tampering of Firearms Serial Number.


The penalty of Prison Correctional (4 years) shall be
imposed upon any person who shall unlawfully
tamper, change, deface or erase the serial number of
any firearm.

 Section 5 - Coverage of the term UNLICENSED


FIREARM.
 The term unlicensed firearm shall include:

 a. Firearm with expired license


 b. Unauthorized use of licensed firearm in the
commission of a crime.
DEFINITION OF TERMS

 1. AMMUNITION - refers to loaded shells for rifles, muskets,


carbines, shotguns, revolvers, pistols and other firearms from
which a bullet, ball, shot, shell or other missile may be fired by
means of gunpowder or explosives.

 2. LICENSE TO POSSESS FIREARM AND AMMUNIION - is a written


authority authorizing a person to possess in his residence a
licensed firearm and an authorized quantity of ammunition.

 3. RESIDENCE - refers to that place where the firearm and


ammunition is being permanently kept. It includes the office or
house where it is kept and the premises of the house enclosed by
walls and gates separating said premises from adjacent
properties. For firearms covered by a Regular License or Special
Permit, their residence shall be specified in the license or permit;
and those covered by a Certificate of Registration or a
Memorandum Receipt, their residence in the office/station to
which the grantee belongs. The vehicle is not an extension of the
firearm residence.
 4. PERMIT TO CARRY FIREARM OUTSIDE
OF RESIDENCE - is a written
authority issued to any person by the
Chief of the Philippine National Police
which entitles such person to carry his
licensed or lawfully issued firearm outside
of residence for the duration and purpose
specified therein.
 5. TRANSPORT PERMIT - is a written
authority granted to licensees or their
authorized representatives to move
firearms from source to residence, firing
ranges and other authorized destinations.
LEGAL SOURCE OF FIREARMS

Firearms and ammunition may be purchased from any of


the following sources:
1. Licensed firearm dealer through purchase.
2. Licensed firearm holder through sale or transfer: the
firearm should be delivered by the vendor to the buyer
only after the latter has secured the corresponding
license.
3. Importation/Purchase abroad: Note – the importation of
firearms and ammunition abroad by individuals has been
suspended by order of the President (SOP NR 13
September 19, 1991)
KINDS OF FIREARM LICENSES
TO POSSESS
 There are six types of licenses.

CARRY AND TRANSPORT OF FIREARMS
 TRANSPORT PERMITS - A one-time pass issued to individuals
for purpose of transporting unloaded firearms and
ammunition from one location to another and vice-versa if
necessary.

 TRANSPORT PERMITS FOR GUN CLUB MEMBERS - A written


authority issued to FED accredited gun club members for
purposes of transporting unloaded firearms and ammunition
from residence to firing ranges and vise-versa. A maximum
duration of 90 days is granted to gun club members.

 HUNTING PERMITS - A written authority issued to individuals


for purposes of transporting unloaded firearms and
ammunition to hunt in legal hunting grounds. These
individuals are required to coordinate with the local PNP unit
or barangay of their activity prior to issuance of a permit.
PERMIT TO CARRY FIREARM OUTSIDE
RESIDENCE (PTCFOR)
A written authority issued to persons
who are under actual threat or
whose lives are in imminent danger
due to the nature of their position,
occupation or calling.
PTCFOR is issued only by the Chief,
PNP or his authorized representative.
PTCFOR are valid for one (1) year
provided the firearm license is valid.
DUTY DETAIL ORDER
A written order or schedule issued by a
superior officer to his subordinate(s)
assigning to the latter the
performance of a specific task(s)
within or outside his official station
which is a part of his regular duties,
usually requiring completion within a
24-hour period.
MISSION ORDER

A written directive or order issued by a competent authority to


persons who are under his supervision and control for a
definite purpose or objective during a specified period and
to such place or places as therein mentioned.

NO MISSION ORDER SHALL BE ISSUED TO ANY CIVILIAN


AGENT authorizing the same to carry firearm outside
residence unless he is included in the regular plantilla of the
law government agency involved in law enforcement and is
receiving regular compensation for the services he is
rendering in the agency. Further, the civilian agent must be
included in a specific law enforcement, police, intelligence
project proposal or special project which specifically requires
the use of firearms(s) to insure its accomplishment and that
the project is duly approved by the PNP Regional Command
level or its equivalent level in other major services of the
AFP and NBI, or higher command.
REVOCATION/TERMINATION OF LICENSE
1. A firearm license shall be revoked under any of the following causes:
a. Loss of firearm through negligence.
b. Carrying of firearm outside residence without the appropriate permit.
c. Carrying of firearm in prohibited places.
d. Conviction by a competent court involving moral turpitude for any offense
where the penalty carries an imprisonment of more than six(6) months and a
fine of at least Php 1,000.00
e. Unauthorized loan of firearm to another person.
f. Dismissal for cause from the service, in the case of government officials and
employees.
g. Commission of crime where the firearm is involved.
2. Upon revocation of the license or termination thereof for any cause, the
firearm and ammunition in the possession of the licensee covered by such
license shall be surrendered to FED, PNP, in case of Metro Manila residents. In
the provinces, the firearms and ammunition shall be surrendered to the
Regional or Provincial Director concerned who shall forward the same to FED,
PNP for proper disposition.
3.Upon the death or legal disability of the holder of a firearm, it shall be the duty of the
nearest relative, legal representative or any person who shall knowingly come into
possession of such firearm and ammunition to deliver the same after securing the
necessary transport permit. It shall be surrendered to the Regional or Provincial
Director for provincial residents or the Chief, FED PNP for Metro Manila residents.
Such firearm and ammunition shall be retained pending issuance of a license in
accordance with the law.
4.In case of loss of a firearm held under SP, LCR or SCR, it shall be the duty of the
Department Secretary, Bureau Director, or Head of Office with equivalent rank to
notify the FED, PNP thereof. It shall also be his duty to require any holder of a firearm
under SP, LCR or SCR in his department, bureau or office to surrender or otherwise
account for the firearm before the holder thereof, resigns, retires or otherwise sever
his connection with the government.
5.For holders of firearms under SRL, it shall be the duty of the employer to
immediately notify the FED, PNP when the firearm is lost. Also, it is duty of the
employer to notify the FED, PNP when the firearm holder resigns, retires or otherwise
sever his connection with the private firm, establishment or corporation, and to
immediately recall the firearm covered by the SRL.
MANNER OF CARRYING
FIREARM
 The sidearm carried by a person in uniform shall be placed
in a holster securely attached to the belt, except that of
military pilots in flying uniform and crew of armored
vehicles who may carry their firearm in shoulder holster.

 Persons in uniform but without holster and those in civilian


clothes who are authorized to carry their firearm outside
residence shall ensure that their firearm is concealed unless
in actual use for legitimate purpose.

 The practice of flagrantly displaying a firearm or tucking it


at the waist while in uniform or civilian clothes is
prohibited.

 Only firearms specifically described in the permit shall be


carried.
REQUISITES FOR A VALID SELF-
DEFENSE
 Article 11. Justifying circumstances. The following do not
incur any criminal liability:

 Anyone who acts in defense of his person or rights,


provided that the following circumstances occur:

 First. Unlawful aggression;

 Second. Reasonable necessity of the means employed to


prevent or repel it;

 Third. Lack of sufficient provocation on the part of the


person defending himself
GUN-PROOF YOUR CHILD
 If a child finds a gun, they should be taught to:

 • STOP AND DON’T TOUCH IT.

 • LEAVE THE AREA

 • TELL A RESPONSIBLE ADULT WHAT THEY FOUND

 The adult should NOT TOUCH the gun either. Even if the
adult is familiar with firearm safety. The gun could be
essential evidence that could be used in solving a crime
and the mere position of the gun could be important. Not to
mention fingerprints, blood or cartridge cases. Obviously
the police should be notified first.
LIMITATIONS AND
RESTRICTIONS
 • Those authorized to carry firearms shall not bring said
firearms inside public drinking places, cabarets, public
dance halls and public amusement places, or while
attending civic, political and religious rallies and meetings.

 • Carrying of long firearms is prohibited in Metro Manila,


chartered cities, provincial capitals, and other thickly
populated areas or fiestas or other large gatherings except
when called for in the performance of duty or
accomplishment of mission.

 • Restrictions on the Carrying of Firearms for Agents of


the NBI, Prison Guards, members of the Bureau of
Customs, Police, Phil. Port Authority Security Force,
Private/Agency Security Guards, Integrated Civilian Home
Defense Forces, etc. are enumerated in the Implementing
Rules and Regulations of Presidential Decree NO. 1866.

 BE SURE OF YOUR TARGET AND WHAT
LIES BEYOND AND AROUND IT
BEFORE YOU SHOOT.
EXECUTIVE ORDER NO. 256
 SECTION 7. No firearm application shall be
approved by the FED, PNP without a
certificate of Attendance by the applicant
in a seminar covering Gun Safety,
Responsibility, Laws, Regulation and other
pertinent topics.

 Done in the City of Manila, this 21st day of


December in the year of our Lord,
Nineteen Hundred and Ninety Five.
ESSENTIAL GUN SAFETY
RULES TO FOLLOW
 Be sure the gun is safe t o operate.
 If you don’t know anything about the gun, seek a
knowledgeable Person.
 Know how to use the gun safely.
 Use ONLY the correct ammunition for the gun.
 Carry only one caliber cartridge or shell at a time.
 Wear eye and ear protection as appropriate.
 NEVER TAKE A GUN AWAY FROM SOMEONE BY
PULLING ON THE BARREL.
 NEVER use drugs or alcohol before or during
shooting.
 NEVER shoot into water and avoid ricochets.
 Store guns and ammunition so it is not accessible
to unauthorized people.
 While hunting, you should positively identify the sex of the
animal before readying your shot.

 While hunting, you should be completely aware of where your


buddies are and carry your firearm accordingly.

 Store firearms and ammunition separately.

 NEVER climb a tree or fence or jump a ditch with a loaded gun.

 Be aware that certain firearms and activities have additional rules


and precautions.

 ALWAYS obey range rules and a Range Safety Officer.

 NEVER rely solely on the safety device on the gun.

 Read and fully understand the manual that came with the gun.

 NEVER allow horseplay with a firearm even if you are certain it is


unloaded.
 Carry guns in cases.
 Be sure the barrel is clear of obstructions. An obstruction
inside the Barrel, such as a bullet or jacket can destroy
the usefulness of the gun and could cause severe injury or
DEATH. If the discharge of the cartridge seemed a bit
different in sound or recoil, the gun should be pointed in a
safe direction for thirty (30) seconds to two (2) minutes,
in case of a hangfire. Then the barrel should be checked
for obstruction. A hangfire occurs when the gun does not
immediately discharge, but discharges a few moments
later.

 If you do a bunch of the shooting at indoor pistol ranges,


you should make sure that the range is fully ventilated
and the fans are properly working. There can be a
relatively high concentration of lead and harmful
compounds in the air if proper ventilation is not observed.
Child-proof guns, or gun-proof children.
 It is a far better thing to gun-proof your children than to child-proof a gun.

 Reality dictates that a sound strategy of both handling procedures and


letting them shoot and clean your guns, coupled with locking up and safely
storing guns and ammunition must be followed.

 IF YOU ARE HIDING A LOADED FIREARM IN YOUR HOME RIGHT NOW, YOU
ARE INVITING A POTENTIAL DISASTER. AT SOME POINT IN THE FUTURE,
SOMEONE MIGHT FIND THAT HIDDEN FIREARM, AND THEY MAY NOT
KNOW WHAT TO DO WHEN THEY FIND IT.

 In general, guns should be stored so that they are inaccessible to


unauthorized children or adults. Simply hiding a loaded firearm is not the
way to go. Lock guns in a rack, cabinet or safe. Store ammunition in a
separate container.

 If you foresee the real possibility of using the firearm for home defense
purposes, there are many products on the market to assist you: Simple
combination, single pistol lock boxes; Fingerprint scanning, single pistol
lock boxes; key locked trigger guards; and Key locked cables.
 Eye and ear protection must be worn at all times while on
the range whether shooting or not.

 Observe the 180 degrees rules on the safety. When allowed


to handle your firearm, always point the muzzle of your
firearm down range. Never hold your firearm if there are
people in front of you or with people downrange.

 In a firing line with no barriers, the person to your right is


always given priority unless otherwise stated.

 Always announce that you are firing before you start


shooting to allow people to prepare for your firing.

 Load firearm only upon the advice of the Range Officer.

 The Range Officer is the only boss inside the firing range.
BASIC SAFETY TIPS IN TRANSPORTING
FIREARMS

 Always transport your firearm in a safe unloaded


condition.
 Never carry any handgun in your pocket, purse or
waistband. Use a case or proper holster.
 When authorizes to carry a firearm with a loaded
chamber, the safety lever must be in the “SAFE”
position. A safer option is to carry the pistol with
a loaded magazine and an empty chamber.
 For revolvers, carry loaded revolvers with an
empty chamber under the hammer.
 Always bring the original copy of your firearm
license and transport permit or PTCFOR when
transporting your firearm.
BASIC MARKSMANSHIP

 Marksmanship is the skillful art


of shooting and hitting a target
at a given range or known
distance.
SHOOTING BASICS
 STANCE – The excellence of a stance is a major factor
in creating conditions for maximum control. Every
individual possesses a combination of individual
characteristics that are peculiar to him alone.
Examples of these are height, weight and proportion
of body development to muscle system. Therefore
there is no definite all purpose stance which applies
equally to all shooters. The shooter on the basis of his
own particular configuration must find a stance which
provides the greatest degree of stability for his body.

 1. CONTROL

 5. NATURAL POINT OF AIM
 6. STANCE WIDTH
GRIP
 Consistency and neutrality are the goals.
You should have a totally neutral feeling in
each hand. Achieving neutrality allows the
grip and stance technique to perform its
most important function: Allowing the gun
to recoil in the same direction, to the
same level and on the same path. The grip
and stance cannot control recoil in the
sense of stopping recoil. That’s not
possible. What is possible is control of the
sight and gun.
BREATHE CONTROL
 The breathing process provides the body with oxygen and
eliminates waste element from the blood. Correct breathing
while shooting is essential to proper body function. A
complete respiratory cycle last for 4-5 seconds (inhaling
and exhaling) and between each cycle there is a pause of
2-3 second.

 This pause can be extended up to 10 seconds without any


special labor or unpleasant sensation. It is during this
pause between breaths that the shooter should fire the
shot.

 The reason is that during the respiratory pause, the


breathing muscles are relaxed thus the shooter avoids
strain from the diaphragm. Also thinking of the need to
breathe does not break his concentration.

 If the holding of the breath is not sufficient to allow the


shot to be fired within the required time, hold fire, release
the trigger,
 resume normal breathing and repeat the process.
SIGHT ALIGNMENT
 Is the relationship between the
rear sight and front sight to
the target with respect to the
eye. The front sight is centered
in the rear sight notch and the
top of the blade is even with top
of the rear sight.

 Is the relationship between the rear
sight and the front sight to the target
with respect to the eye. This differs
from sight alignment only by adding
the target. In this situation there are
three objects in front of the eye. –
The rear sight, the front sight and the
target. Since the eye can only focus
on one, the focus should be on the
front sight.

Aiming point commonly used:

 Six-O’clock and Twelve-O’clock


hold. Reference is a clock. Thus,
when it is said that shooter is
hitting 3 O’clock, it means that
the hits are right of the target.

TRIGGER CONTROL
 Is the method used to apply
pressure on the trigger so that
the shot can be fired with least
amount of disturbance to sight
alignment. It is the independent
action of the trigger with
uniform increasing pressure
straight to the rear after the
slack has been taken.
ERRORS IN TRIGGER CONTROL
 Flinching – Muscular tension or
reaction in anticipation of the recoil.
It is caused by moving the head,
closing the eyes, moving the
shoulder to the rear or combination.
 Jerking – An attempt to make the
pistol fire at a certain instant by
rapidly applying pressure on the
trigger.
FOLLOW THROUGH AND
CALLING OF SHOTS

 FOLLOW THROUGH - Is the continued


and physical application of the
fundamentals after each round has
been fired. The Shooter must not shift
his position, move his head or bring
down the pistol for a few seconds
after firing a shot.
 CALLING THE SHOTS – Is the
prediction of the shots on where the
hits are on the target.
