RULE VI – PREPARATION OF BIDDING
DOCUMENTS

CONTENTS OF BIDDING
DOCUMENTS
1. The bidding documents shall clearly
defines the objectives, scope and
expected outputs and or results of the
proposed contract;
2. The expected contract duration; the
estimated quantity in the case of
procurement of goods, delivery
schedule and or time frame;
3. The obligations, duties and or functions
of the winning bidder, and

4. The minimum eligibility requirements
of bidders, such as track record to be
determined by the head of the
procuring entity.
5. The procuring entity may require
additional document requirements or
specifications such as summary data,
facilities and or services where
applicable and necessary to complete
the information for the bidders to
prepare and submit their respective
bids.

6. Prospective bidders shall be given
ample time to examine the bidding
documents and to prepare their
respective bids. Bidders may be asked
to pay for the bidding documents to
recover the cost of preparation and
development. The BAC will issue the
bidding documents upon payment of
the cost thereof to the collecting
officer of the procuring entity.

DETAILED ENGINEERING FOR
THE INFRASTRUCTURE
PROJECT
No bidding and award of contract for
Infrastructure Projects shall be made
unless the detailed engineering
investigations, surveys and designs, for the
project have been sufficiently carried out
and duly approved in accordance with the
standards and specifications prescribed by
the head of the procuring entity concerned
or his duly authorized representative,
pursuant to the recommendation of the
end-user or implementing unit and in
accordance with the provisions of Annex
“A” of this IRR.

RESPONSIBILITY OF
PROSPECTIVE OR ELIGIBLE
BIDDERS
1. Carefully examine all bidding
documents;
2. Having acknowledged all conditions,
local or otherwise, affecting the
implementation of the contract.
3. Have made an estimate of the facilities
available and needed for the contract
to be bid, if any;
4. Have compiled with the responsibility
as provided for under Supplemental
Bid Bulletin.

RESPONSIBILITY OF
PROSPECTIVE OR ELIGIBLE
BIDDERS
4. Have examined:
• The location and the nature of the
contract, project of work;
• Climatic condition;
• Transportation facilities;
• Nature and condition of the terrain;
• Geological conditions and
communication facilities, proximity to
construction aggregates and other
materials;
• Labor, water, power and access roads;
and
• Other factors that may affect the cost,
duration and execution or
implementation of the work.

FOR THE ABOVE PURPOSE, ALL BIDDERS SHALL EXECUTE A SWORN STATEMENT
ATTESTING TO THE FOREGOING RESPONSIBILITIES, TO BE SUBMITTED AS AN
ANNEX TO ITS TECHNICAL PROPOSAL.
RULE VII– INVITATION TO BID

PRE-BID CONFERENCE
1. The pre-bid conference shall be
held at least 12 calendar days
before the deadline for the
submission and receipt of bids.
Attendance of the bidders is not
mandatory.
2. The pre-bid conference shall
discuss the technical and financial
components of the contract to be
bid, and the procurement of goods
the eligibility requirements.
Minutes of the pre-bid shall be
recorded and made available not
later that 3 calendar days after the
conference.

3. Any statement made at the pre-


bid conference shall not modify
the terms of the bidding
documents, unless such
statement is specifically identified
in writing as an amendment and
issued as Supplemental Bid
Bulletin.

SUPPLEMENTAL BID
BULLETIN
1. Request for clarification on any
part of the bidding documents or
for an interpretation shall be in
writing submitted to BAC at least
10 calendar days before the
deadline set for the submission
and receipt of bids.
2. The BAC shall respond to the
written request at least 7
calendar days before the deadline
for the submission and receipt of
bids.

SUPPLEMENTAL BID
BULLETIN
3. Any modification to the bidding
documents shall be identified as
an amendment. Bidders who
submitted bids before the
issuance of the Supplemented Bid
Bulletin must be informed and
allowed to modify or withdraw
their bids in accordance with Sec.
26 Art. VIII of R.A. 9184.
