Sexual Harassment

◦It is an uninvited and unwelcome verbal


or physical behavior of a sexual nature
especially by a person in authority
toward a subordinate.
(as an employee or student)

◦ It is committed by an employer, employee, manager, supervisor,
agent of the employer, teacher, instructor, professor, coach, trainer
or any other person who, having authority, influence or moral
ascendancy over another in a work or training or education
environment, demands requests or otherwise requires any
sexual favor from the other, regardless of whether the demand,
request or requirement for submission is accepted by the object of
said act

When is Sexual Harassment Committed?
◦ In an Education or Training Environment

1. When one who is under the care, custody or supervision


of the offender;

2. When one whose education, training, apprenticeship or


tutorship is entrusted to the offender
In an Education or Training Environment

3. When the sexual favor is made as a condition to the giving of a


passing grade, or the granting of honors and scholarships, or the
payment of a stipend, allowance or other benefits, privileges or
considerations

4. When the sexual advances result in an intimidating, hostile, or


offensive environment for the student, trainee or apprentice
WHEN IS SEXUAL HARASSMENT
COMMITTED IN AN EDUCATION OR
TRAINING ENVIRONMENT
Education or Training Related Sexual
Harassment is Committed when:
1. the submission to or rejection of the act or series
of acts is used as a basis for any decision affecting
the complainant, including, but not limited to, the
giving of a grade, the granting of honors or a
scholarship, the payment of a stipend or allowance
or the giving of any benefits, privilege or
consideration
2. The act or series of acts have the purpose or
effect of interfering with the performance, or
creating an intimidating, hostile or offensive
academic environment of the complainant
3. The act or series of acts might reasonably
be expected to cause discrimination,
insecurity, discomfort, offense or
humiliation to a complainant who may be
a trainee, apprentice, intern, tutee or ward
of the person complained of

A. Gender Harassment

o Generalized sexist language and behavior that


convey insulting remarks, offensive graffiti, obscene
jokes or humor about sex or women in general
B. Sexual Imposition

◦ Gross sexual imposition such as forceful touching


feeling, grabbing, or sexual assault
C. Seductive Behavior
◦ Unwanted, inappropriate and offensive sexual
advances
Examples:
Repeated, unwanted sexual invitations, insistent
requests for dinner, drinks, dates,
Persistent letter, phone calls and other invitations
D. Sexual Coercion

◦ Coercion of sexual activity or other sex-linked


behavior by threat of punishment
Example:
negative performance evaluations
withholding of promotions
threat of termination
E. Sexual Bribery
◦ Solicitation of sexual activity or other sex-linked
behavior by promise of reward; the proposition may
be either overt or subtle
Specific Forms
◦ Sending sexual mail, notes, e-mail, or making sexually
explicit phone calls
o Sending, giving, showing or displaying sexual materials
pornography, sexual pictures, cartoons & calendars
o Laughing at or not taking seriously someone who
experiences sexual harassment
oBlaming the victim of sexual harassment for having caused

PENALTIES FOR
OFFENSES OF SEXUAL
HARASSMENT
Light Offenses
• First Offense – Reprimand
• Second Offense – Fine or suspension not exceeding thirty (30) days
• Third Offense - Dismissal

Less Grave Offenses

• First offense –Fine or suspension for thirty (30) days but not exceeding six (6)
months
• Second Offense – Dismissal
Grave Offenses
• Dismissal
