THE SHOE BOX
A man and woman had been
married for more than 60 years.
They had shared everything.
They had talked about everything.

other except that the wife had a

closet that she had
cautioned her husband never to
open it or ask her about it.
For all of these years, he had
never thought about the box, but
one day the wife got very sick

One young man went to apply for a
managerial position in a big
company. He passed the initial
interview, and now would meet the
Director for the final interview.
The Director discovered from his CV
that the youth’s academic
achievements were excellent. He
asked :”Did you obtain any
scholarship in school? The youth
answered “No”.
“ Was it your father who paid for
your school fees?”
“My father passed away when I was
one year old, it was my mother who
paid for my school fees”, he replied.
“Where did your mother work?”
“My mother worked as clothes
cleaner”.
The Director requested the youth to
show his hands. The youth showed
a pair of hands that were smooth
and perfect.
“Have you ever helped your mother
wash the clothes before?”
“Never, my mother always wanted
me to study and read more books.
Besides, my mother can wash
clothes faster than me”.
The Director said: “I have a
request. When you go home today,
go and clean your mother’s hands
and then see me tomorrow
morning”.
When the youth went home, he
asked his mother to let him clean
his hands. His mother felt strange,
happy but with mixed feelings. She
showed her hands to her son.
The youth cleaned his mother’s
hands slowly. His tear fell as he did
that. It was the first time he noticed
that his mother’s hands were so
wrinkled, and there were so many
bruises. Some bruises were so
painful that his mother winced
when he touched it.
This was the first time that the
youth realized that it was this pair
of hands that washed the clothes
everyday to enable him to pay his
tuition fees.
The bruises in his mother’s
hands were the price that the
mother had to , pay for his
education. his school activities
and his future.
After cleaning his mother’s
hands, the youth quietly washed
all the remaining clothes for his
mother. That night the mother
and son talked for a long time.
Next morning, the youth went to
the Director’s office. The Director
noticed the tears in the youth’s
eyes. He asked: “ Can you tell me
what have you done and learned
yesterday in your house?”
The youth answered:” I cleaned
my mother’s hands and also
finished cleaning the remaining
clothes”.
“I know now what appreciation
is. Without my mother I would
not be who I am today. By
helping my mother, only now do
I realize how difficult and tough
it is to get something done on
your own. And I have come to
appreciate the importance and
value of helping one’s family”.
LESSON OF THE STORY
We can let our children live in a big
house, eat a good meal, learn piano,
watch on a big screen TV. But when you
are cutting grass, please let them
experience it. After a meal, let them
wash their plates and bowls together
with their brothers and sisters. It is not
because you do not have money to hire
a maid, but it is because you
want to love them in a right way.
You want them to understand, no
matter how rich their parents are,
one day their hair will grow gray,
same as the mother of that young
person. The most important thing is
that your child learns how to
appreciate the effort and experience
the difficulty and learns the ability to
work with others to get things done.
It is not what you do for your children
but what you have taught them to do for
themselves, that will make them
successful HUMAN BEINGS….

2004 (RA 9262)
What is the Anti-Violence Against
Women and Children Act of 2004
or RA 9262?

It is the law penalizing acts of violence


against women and their children as a
public crime.
VAWC refers to any act or series
of act committed by any person
against a woman who is his wife,
former wife , or against a woman
with whom the person has or had a
sexual or dating relationship or with
whom he has a common child or
against his child whether legitimate
or illegitimate, inside
or outside the family residence,
which result or is likely to result in
physical, sexual, psychological harm
or suffering or economic abuse. It
includes threats of the above acts,
battery, assault, coercion,
harassment or arbitrary deprivation
of liberty.
WHO ARE PROTECTED BY THE
LAW?

- Women and their children.


- Children means children of the abused
woman, below 18 years of age,
legitimate or illegitimate , or 18 years
old & above, who are incapable of
taking care of themselves, including
children who are not her biological
children but are under her care. Ex. Her
niece, under her care.
WHO CAN BE HELD LIABLE?

1) Husbands
2) Former husbands
3) Present or former boyfriends, or live-
in partners
4) Those w/ whom the woman has a
common child
5) Anyone w/ whom she has/had sexual
or dating relationship
CAN A WOMAN BE HELD
LIABLE UNDER THE LAW?

YES. These are the lesbian partners/


girlfriends or former partners of the
victim with whom she has /had a sexual
or dating relationship (DILG
implementing Rules on the Brgy.
Protection Order).
DATING RELATIONSHIP –
refers to a situation wherein the
parties live as husband and wife
without the benefit of marriage or
are romantically involved one
time and on a continuing basis
during the course of the
relationship.
What is “ SEXUAL RELATIONS” ?
Sexual relations refer to a single
sexual act which may or may not
result in the bearing of a common
child.
Ex. A prostitute can avail of the
remedies if she is being harassed by
a man with whom she had a single
sexual contact.
THESE ACTS INCLUDE:

1) Physical violence
2) Sexual violence
3) Psychological violence
4) Economic violence
A) PHYSICAL ABUSE/VIOLENCE
- refers to acts that includes bodily or
physical harm.
a) Physical Injuries
b) Frustrated/Attempted Parricide
c) Threatening to cause the woman
or her child physical harm ;
d) any attempt to cause any harm.
PUNISHABLE ACTS OF VIOLENCE

B) SEXUAL VIOLENCE- refers to an act


which is sexual in nature committed
against a woman or her child. It includes
but not limited to:
a) Rape, sexual harassment, acts of
lasciviousness, treating a woman or her
child as sex object, making demanding
and sexually suggestive remarks,
physically attacking the
the sexual parts of the victim’s body,
forcing her to watch obscene
publications and indecent shows or
forcing the woman or her child to do
indecent acts and/or make films
thereof, forcing the wife and mistress
to live in the conjugal home or sleep
together in the same room with the
abuser.
b) Acts causing or attempting to
cause the victim to engage in any
sexual activity by force, threat of
force, physical or other harm or
threat of physical or other harm or
coercion;
c)) Prostituting the woman or her
child.
C) PSYCHOLOGICAL ABUSE/VIOLENCE

- refers to acts or omissions causing


or likely to cause mental or emotional
sufferings to the victim.
a) Marital Infidelity
b) Public humiliation or ridicule
c) Verbal abuse
d) Stalking
e) Deprivation of rights of custody or
visitation of her child/
D) ECONOMIC ABUSE/VIOLENCE
refers to acts that make or attempt to make
a woman financially dependent which
includes but not limited to the following:
a) withdrawal of financial support or
preventing the victim from engaging in any
legitimate profession, occupation, business
or activity except in cases wherein the
other spouse /partner objects on valid,
serious and moral grounds;
b) deprivation or threat of
deprivation of financial. resources
and the right to the use and
enjoyment of the conjugal
community or property owned in
common;
c) destroying household property;
d) controlling the victim’s own
money or properties or solely
controlling the conjugal
money or properties..
BATTERY –act of inflicting physical
harm upon the woman or child
resulting to emotional, physical or
psychological distress.
BATTERED WOMEN SYNDROME
– refers to a scientifically defined
patterned of psychological and
behavioral symptoms found in
women living in battering
relationships as a result of
cummulative abuse.
WHAT ARE THE REMEDIES
OF THE VICTIM?
She and her child can request for:

1) Barangay Protection Order (BPO)


2) Temporary Protection Order (TPO)
3) Permanent Protection Order (PPO) w/ the
court &
4) File a criminal action for violation of RA 9262.
WHAT IS A BARANGAY
PROTECTION ORDER OR BPO?

This refers to the Protection Order


issued by the Punong Barangay , or
if the Punong Barangay is
unavailable, by a Kagawad,
ordering the offender to desist from
committing or threatening physical
harm to the victim. It is effective for
15 days and is not extendible.
HOW DOES THE VICTIM GET A
BPO?
She or her child can go to the Punong
Barangay, or if he is unavailable, to the
Kagawad, & apply for a BPO. The
application must be in writing, signed
and under oath. It shall be attested by
the Punong Barangay who has
jurisdiction over the application.
WHAT IS ANOTHER OPTION FOR
THE WOMAN OR THE CHILD?
With or without a BPO, she can apply
for a Temporary Protection Order
(TPO) from the Family Court in her
place of residence or if there is no
Family Court, in the Regional Trial
Court, Municipal Trial Court , Municipal
Circuit Court or Metropolitan Trial
Court.
TEMPORARY & PERMANENT
PROTECTION ORDERS ISSUED BY THE
COURT
TPO will be issued upon the filing of the
petition after an ex-parte proceedings is
conducted by the court if such relief is
badly needed and this is effective for
thirty (30) days.. Then the court shall
schedule the hearing for the issuance of
the Permanent Protection Order prior
to the
expiration of the TPO The TPO shall
include the date of the date of the
hearing of the PPO. Respondent's non-
appearance despite notice or lack of
lawyer shall not be a ground for the
postponement of the hearing. As to the
non availability of his lawyer, the court
will appoint a lawyer for him.
WHAT SHOULD THE BARANGAY
OFFICIALS DO WHEN THE VICTIM
APPLIES FOR BPO?
1) Assist her in writing the application , if
there is no notary public or it is an
emergency, have the applicant take an oath
before the PB that her statements are true.

2) Ask questions on the salaysay or


statements of the applicant. Be sure the
date of commission of the offense, place &
specific circumstances are in the statement.
WHO CAN FILE PETITION FOR
ISSUANCE OF PROTECTION ORDER
1) Offended Party
2) Parents or guardian of the offended
party
3) Ascendants, descendants or
relatives within the 4th civil degree of
consanguinity or affinity
4) Officers or Social Workers of DSWD
or Social Workers of LGUs
5) Police Officers especially those in-
charge of the Women”s and
children”s desk
6) Punong Barangay or Barangay
Kagawad
7) Lawyer counselor, Therapist or
Healthcare provider of the pet.
8) At least two (2) responsible
citizens of the City or Municipality
where the violence against the
woman and child occurred and who
has personal knowledge of the
offense committed.
CAN THE BARANGAY
OFFICIALS MEDIATE OR
CONCILIATE?
NO. Conciliation or mediation of
acts of violence against women
and her children are not allowed
under the law.
WHAT ARE THE DUTIES OF
BARANGAY OFFICIALS & LAW
ENFORCERS?
1)Enter the house of the victim, if necessary,
whether or not a BPO or TPO has been issued
and secure the safety of the victim.

2) Confiscate any deadly weapon in the


possession of the perpetrator or in plain view.
3) Arrest the offender even if there
is no Warrant when the act is being
committed or they have personal
knowledge that the abuse has just

CAN THE BARANGAY OFFICIALS ARREST
THE PERPETRATOR WITHOUT A
WARRANT?
Yes, when the acts constituting violation
of RA 9262 is occurring or when the
Barangay Officials have personal
knowledge that any act of abuse has
just been committed and there is
imminent danger to the life or limb of the
victim.
Any citizen or Law Enforcers can
also arrest the perpetrators if the
situation falls under the Rules on
Warrantless Arrest or when they
have personal knowledge that the
act of abuse has just been
committed and in the presence of
imminent danger to the life or limb of
the victim.
CAN THE BARANGAY OFFICIALS,
POLICE OR SOCIAL WORKERS BE
SUED FOR TRESPASSING IF THEY
ENTER THE HOUSE OF THE VICTIM?

NO. They are exempt from civil, criminal


& administrative liability. This include
private persons or even foreigners who
render assistance.
WHAT ARE THE RIGHTS OF THE
VICTIM?
1) To be treated with respect & dignity;
2) Legal Assistance from the PAO, or
any public legal assistance including
the local government;
3) Support services from the DSWD or
local government;
4) To be informed of their rights and
services available , including the right to
a protection order; and

5) If the victim is indigent or even if she


is not, but there is an immediate
necessity to act on the protection order,
the victim can file for a protection order
in court without paying the court fees.
