Sangguniang Kabataan

Legal Basis
Sec. 13, Article II of the 1987 Constitution the State recognizes the vital role of the youth in nation building, . . . Shall promote and protect their physical, moral, spiritual, intellectual and social well-being . . . shall inculcate in the youth patriotism and nationalism and encourage their involvement in political and civic affairs.

Katipunan ng Kabataan
The KK shall be composed of all citizens of the Philippines actually residing in the barangay for at least six (6) months, who are fifteen (15) but not more than eighteen (18) years of age, and who are duly registered in the Katipunan ng Kabataan roster or in the official list in the custody of the Sangguniang Barangay Secretary.

The KK shall meet at least once every quarter (or three months) or at the call of the Chairman of the sangguniang kabataan or upon written petition of at least onetwentieth (1/20) of its members, to decide on important issues affecting the youth of the barangay.

Rights and Responsibilities: 1. The right or duty to vote and be elected or voted upon during the SK elections 2. The right or duty to participate in the planning and implementation of the programs, projects and activities of the barangay as may be adopted by the SK or Sangguniang Barangay

Creation and Election: There shall be in every barangay a sangguniang kabataan to be composed of a chairman, seven (7) members, a secretary, and a treasurer.

Powers and Function The Sangguniang Kabataan shall: 1. Promulgate resolutions necessary to carry out the objectives of the youth in the barangay in accordance with the applicable provisions of the LGC; 2. Initiate programs designed to enhance the social, political, economic, cultural, intellectual, moral, spiritual, and physical development of the members;

3. Hold fund-raising activities, the proceeds of which shall be tax-exempt and shall accrue to the general fund of the sangguniang kabataan: Provided, however, That in the appropriation thereof, the specific purpose for which such activity has been held shall be first satisfied; 4. Create such bodies or committees as it may deem necessary to effectively carry out its programs and activities;

5. Submit annual and end-of-term reports to the sangguniang barangay on their projects and activities for the survival and development of the youth in the barangay; 6. Consult and coordinate with all youth organizations in the barangay for policy formulation and program implementation;

7. Coordinate with the appropriate national agency for the implementation of youth development projects and programs at the national level; and 8. Exercise such other powers and perform such other duties and functions as the sangguniang barangay may determine or delegate or as may be prescribed by law or ordinance

Meetings of the SK: The Sangguniang Kabataan shall meet regularly once a month on the date, time, and place to be fixed by the said sanggunian. Special meetings may be called by the sangguniang kabataan chairman or any three (3) of its members by giving written notice to all members of the date, time, place, and agenda of the meeting at least one (1) day in advance. Notices of regular or special meetings shall be furnished the punong barangay and the sangguniang barangay.

Qualifications:  citizen of the Philippines  A qualified voter of the katipunan ng kabataan  a resident of the barangay at least one (1) year immediately prior to election  at least fifteen (15) but not more than eighteen (18) years of age on the day of the election  able to read and write Filipino, English, or the local dialect  must not have been convicted of any crime involving moral turpitude (rape, theft, slander)

Term of Office: The Sangguniang Kabataan Chairman and Members shall hold office for a period of three (3) years, unless sooner removed for cause as provided by law, permanently incapacitated, die or resign from office.

SK Chairman: The registered voters of the Katipunan ng Kabataan shall elect the Chairman of the Sangguniang Kabataan who shall automatically serve as an ex-officio member of the sangguniang barangay upon his assumption to office. As such, he shall exercise the same powers, discharge the same duties and functions, and enjoy the same privileges as the regular sangguniang barangay members, and shall be the chairman of the committee on youth and sports development in the said sanggunian.

Powers and Duties of the SK Chairman: 1. Call and preside over all meetings of the KK and the SK; 2. Implement policies, programs, and projects within his jurisdiction in coordination with the sangguniang barangay; 3. Exercise general supervision over the affairs and activities of the SK and the official conduct of its members, and such other officers of the SK within his jurisdiction

Powers and Duties of the SK Chairman: 4. With the concurrence of the SK, appoint from among the members of SK, the secretary and treasurer, and such other officers as may be necessary; and 5. Exercise such other powers and perform such other duties and functions as may be prescribed by law or ordinance.

Powers and Duties of the SK Secretary: 1. Keep all records of the KK and SK; 2. Prepare and keep the minutes of all meetings of the KK and SK; 3. Prepare all forms necessary for the conduct of registrations, elections, initiatives, referenda, or plebiscites, in coordination with the barangay secretary and the Comelec; and

Powers and Duties of the SK Secretary: 4. Perform such other duties and discharge such other functions as the chairman of the sangguniang kabataan may prescribe and direct.

Powers and Duties of the SK Treasurer: 1. Take custody of all SK property and funds not otherwise deposited with the city treasurer; 2. Collect and receive contributions, monies, materials, and all other resources intended for the SK and KK; 3. Disburse funds in accordance with an approved budget of the SK;

Powers and Duties of the SK Treasurer: 4. Certify to the availability of funds whenever necessary; 5. Submit to the SK and to the sangguniang barangay certified and detailed statements of actual income and expenditures at the end of every month;

Powers and Duties of the SK Treasurer: 6. Perform such other duties and discharge such other functions as the chairman of the sangguniang kabataan may prescribe and direct.

Privileges of SK Chairman:  The same privileges enjoyed by other sangguniang barangay officials under the LGC subject to such requirements and limitations provided in the Code.
    Honorarium Bonus Medical Benefits (If there is appropriation) Free Insurance (disability, death and burial), etc.

Privileges of all SK officials:  Free tuition and matriculation fee while enrolled in public tertiary schools, including state colleges and universities within or nearest their area of jurisdiction.

Succession and Filling of Vacancies: 1. Refusal to assume office 2. Failure to qualify 3. Conviction of felony 4. Voluntary resignation 5. Death 6. Permanently incapacitated 7. Removal from office 8. Absence without authorization for more than three (3) consecutive months

Grounds for Disciplinary Actions (Art. 124): 1. Disloyalty to the Republic of the Philippines 2. Culpable violation of the Constitution 3. Dishonesty, Oppression, Misconduct in Office, Gross Negligence, or Dereliction of Duty 4. Commission of any offense involving moral turpitude or an offense punishable by at least prision mayor which is from six (6 years and one day to twelve (12) years imprisonment 5. Abuse of authority

Unauthorized absence for fifteen (15) consecutive working days, except in the case of members of the sangguniang panlalawigan, sangguniang panlungsod and sangguniang barangay which is four consecutive absence in sessions Application for, or acquisition of, foreign citizenship or residence or the status of an immigrant of another country Such other grounds as may be provided by the LGC and other laws (RA 6713, RA 3019, Admin Code of 1987, Revised Penal Code)

Task Forces based on SK Constitution and ByLaws (Article XVIII): 1. Green Brigade Headed by the First Kagawad and shall have a membership of ten percent (10%) of the KK Members; 2. Livelihood and Entrepreneurship Headed by the Second Kagawad and shall have a membership of ten percent (10%) of the KK Members;

Disaster Coordination and Health Headed by the Third Kagawad and shall have a membership of twenty percent (20%) of the KK Members; 4. Education Services, Moral Recovery Activities and Anti-Drug Abuse Campaign Headed by the Fourth Kagawad and shall have a membership of twenty percent (20%) of the KK Members;

Sports program and Community Immersion Activities Headed by the Fifth Kagawad and shall have a membership of twenty percent (20%) of the KK Members; 6. Infrastructure Headed by the Sixth Kagawad and shall have a membership of ten percent (10%) of the KK Members;
