Malegaon Blast Case So Far

UPA’s Double Standards
 Mohd Afzal, was awarded death penalty by three courts including the
Supreme Court
 UPA did not execute him because there were rallies in Kashmir in his support
 UPA said ‘It did not want another martyr’
 Relatives of victims of attack on Parliament returned the medals they had
received from the government

UPA’s change of tract – now it says his death penalty is in


process…
it will take time

Newspapers like TOI mentioned this on front page, but did not remind
people about UPA’s earlier stand
Existing laws sufficient to tackle terrorism?
 UPA at the Centre revoked POTA on the plea that existing laws are
adequate to tackle terrorism, both at the Central and state levels
 Gujarat’s request for special act was not approved by UPA
 The same UPA used MOCOCA on the Malegaon accused

Were the existing laws not sufficient for the Malegoan accused?
Why was MOCOCA (a special act) required?
Malegaon accused vs. Jammia accused
 NARCO not used for Jammia accused, they are not booked under MCOCA
like acts

 A supplementary interrogation technique — used to cover missing links in


criminal cases like the Telgi stamp paper scam — was used as a primary
tool of investigation, repeatedly

 First they said an army officer used 60 kg of RDX to blow up the Samjhauta
Express. Then the denial comes; no RDX was used, it was ammonium
nitrate, oh no perhaps IEDs. Then the Mecca Masjid blasts are linked with
Malegaon. then the Hyderabad police issue an official statement that
nothing has been found to link the two
Dukhtaran-e-Millat in Kashmir
 Its leader Asiyah Andrabi works against India
 Conduit for money to jihadi groups
 Dukhtaran-e-Millat activist responsible for a parcel bomb
blast at the BBC office in Srinagar in which one person
was killed and two injured
 Andrabi was booked under POTA

She was never subjected to a narco test


ATS under political pressure?
 ATS alleged Malegaon bombers actually intended to kill
senior RSS leaders.
 Including Indreesh, who was the supposed ideological
fountainhead of the Hindu terror conspiracy
 The "Hindu terrorists" decided to eliminate Indreesh and Mohan
Bhagwat, RSS sarkaryavah (General Secretary) and No 2 in the
organisation, apparently because of their "soft line" towards
Muslims.

Was the RSS masterminding this so-called terror plot,


OR
Was it the plotters' intended target?
What do servicemen say?
 Mr KPS Gill, led a citizens’ delegation to the National Human Rights
Commission where he said that never in his career had he seen
such a prolonged police remand for any woman, let alone a sadhvi.

 Army does not stock RDX

 Lt. Colonel Purohit had no access to any explosives nor knowledge


of bomb-making

 No way an Army officer could be involved in so much covert activity


without being detected.

Unbiased Media?
 Some channels showing individual pictures of Shri Ravi Shankar,
Pragya, and other accused together as if they all were involved in a
conspiracy. Even a doctor treating them can be booked!

 Photographs of public functions where media was present are


being projected as evidence of a private conspiracy
Argument of the Defence
 MCOCA was not applicable to the case, that the accused had
already been tortured in custody, and the ATS had come up with no
new evidence to justify their fresh questioning
 The defence pointed out that MCOCA was applicable only to
crimes for financial gain and not to acts of terrorism

"It is a big blow for the cops. Usually, police custody is granted by the
courts but for it not to be given at the first remand itself is a serious matter,"
said former IPS officer and lawyer Y P Singh while commenting on the
developments. "I have never heard of such a thing. It is very rare," he
added
