DEFINITIONS
Collective Bargaining Agent

It means the trade union of the workmen which is the elected rep of workmen in the factory , for collective bargaining

Industrial Dispute
Industrial dispute means any dispute or difference between employers and employers or between employers and workmen or between workmen and workmen which is connected with the employment or non-employment or the terms of employment or the conditions of work of any person. Industrial dispute excludes the enforcement of any right guaranteed or secured to him by or under any law, other than the above Ordinance, or any award or settlement for the time being in force.

Lock-out Lock out means the following:Closing of a place of employment or part of such place, or The suspension, wholly or partly of work by an employer, or Refusal, absolute or conditional, by an employer to continue to employ any number of workmen employed by him The above act of closing, suspension or refusal in connection with an industrial dispute or is intended for the purpose of compelling workmen employed to accept certain terms and conditions

Strike

Strike means: A cessation of work by a body of persons employed in

any establishment acting in combination, or Concerted refusals, or Refusal under a common understanding of any number of persons who are employed to continue to work or to accept employment

REQUIREMENTS FOR REGISTRATION OF TRADE UNION


To obtain registration of a trade union under the above

Ordinance, the following matters should be provided: The name and address of the trade union The objects for which the trade union has been formed The purposes for which the general funds of the union shall be applicable The number of persons forming the executive which shall not exceed the prescribed limit and shall include not less than seventy five percent from amongst the workmen actually employed in the establishment for which the trade union has been formed The conditions under which a member shall be entitled to any benefit assured by the constitution of the trade union and under which any fine or forfeiture may be imposed on him

The maintenance of a list of the members of the trade union and

of adequate facilities for the inspection thereof by the officers and members of the trade unions The manner in which the constitution shall be amended The safe custody of the funds of the trade union, its annual audit, the manner of audit and adequate facilities for inspection of the account books by the officers and members of the trade union The manner in which the trade union may be dissolved The manner of election of officers by the general body of the trade union and the term, not exceeding two years for which an officer may hold office upon his election or re-election The procedure for expressing want of confidence in any officer of the trade union The meetings of the executive of the general body of the trade union, so that the executive shall meet at least once every year

Every registered trade union shall maintain a register in a prescribed

form showing subscriptions paid by each member, an accounts book showing receipts and expenditure and a minute book for recording the proceedings of meeting On registering a trade union the registrar shall issue a certificate of registration in the prescribed form. The registration of a trade union shall be cancelled if the Labour Court so directs upon a complaint in writing made by the Registrar that the trade union has committed the following:Contravened or has been registered in contravention of any of the provisions of the Ordinance or the rules, or Contravened any of the provision of its constitution, or Made in its constitution any provision which is inconsistent with the Ordinance or the rules. A right to appeal against cancellation lies to the Labour Court

POWER AND FUNCTIONS OF REGISTRAR


Provincial Government has been empowered to appoint as

many persons as it considers necessary to be the Registrars of trade unions and issue the notification. Powers and Functions of the Registrar The registration of trade unions under the above ordinance and the maintenance of a register for this purpose. To lodge, or authorize any person to lodge, complaints with the Labour Court or Commission for action, including prosecution, against trade unions, employers, workers or other persons for any alleged offence or any unfair labour practice or violation of any provision of the ordinance or for expending the funds of a trade union in contravention of the provision of its constitution.

The determination of the question as to which one of

the trade unions in an establishment or an industry is entitled to be certified as the collective bargaining agent in relation to that establishment or industry To inspect the accounts and record of the registered trade unions, or investigate or hold such inquiry as he deems fit, either himself or through any officer subordinate to, and authorised in writing in this behalf by him and Such other powers and functions as may be prescribed

WORKERS PARTICIPATION IN MANAGEMENTFUNCTIONS


Framing of services rules and policy about promotion

and discipline workers. Changing physical working conditions in the factory. In service training of workers. Recreation and welfare of workers. Regulation of daily working hours and breaks. Preparation of leave schedule. Matters relating to the order and the conduct of workers within the factory

POWERS OF INSPECTOR
He may at any time enter on the premises and examine any register, document and take on the spot any evidence of any person and exercise other power of inspection. He may collect the info from the management for the discharge of his function. He may report in writing to the registrar.

WORK COUNCIL-FUNCTIONS
To promote measures for securing and promoting

good relations between employer and workmen. To improve production, productivity and efficiency.\ To endeavor to maintain continuous sympathy between the employer and the work men. To promote settlement of differences and disputes through bilateral negotiations. To promote security of employment for the workmen and conditions of safety, health and job satisfaction in their work.

JOINT MANAGEMENT BOARDFUNCTIONS


Workers participation is 30% and the management participation is 70%. The joint management shall look after the following matters: Improvement in production, productivity and efficiency. Fixation of job and piece rate. Planned regrouping or transfer of worker. Laying down the principles of remuneration and introduction of new remuneration methods . Provision of minimum facilities for workers employed through contractors that are not covered by the laws relating to the welfare of workers.

SHOP STEWARD
50 or more workmen are employed. Nominated by collective bargaining agent. Elected at a secret ballot. Holds office for an year.

Functions: i. He acts as a link between the workers and the employers. ii. He assists in improving the physical working conditions and production work in the shop, section, or department. iii. He helps workers in settlement of their problems regarding work and individual grievance.

SETTLEMENT OF INDUSTRIAL DISPUTE


Shop steward or Work Council reports dispute to CBA

CBA communicates in writing to employer


Employer/Management has 10 days to settle/sign

memo of settlement Within 7 days notice of strike/Lock out Conciliators appointed for conciliation (14 days) Arbitration (30 days) Labor Court Provincial Labor appellate tribunal NIRC

ILLEGAL STRIKES AND LOCK OUTS


It is declared, commenced or continued without giving to the

other party to the dispute, in the prescribed manner, a notice of strike or lock-out or before the date of strike or lock-out specified in such notice, or It is declared, commenced or continued in consequence of an industrial dispute raised in a manner other than that provided in section 43, i.e. without giving it in writing by CBA It is continued in contravention of an order of status quo be maint by Conciliator, Arbitrator , Lab our Court ,Tribunal or NIRC It is declared, commenced or continued during the period in which a settlement or award is in operation in respect of any of the matters covered by a settlement of award. A lock out declared in consequence of an illegal strike and a strike declared in consequence of an illegal lock out be deemed to be illegal.
