ПРЕДИСЛОВИЕ

Предлагаемое учебное пособие представляет собой продолжение курса грамматики


английского языка для студентов юридических специальностей, факультетов и вузов “English
Grammar for Law Students, intermediate course”, Кочетковой С.Ю., Елтанской Е.А., Медведевой
Л.В.. Оно состоит из 9 разделов, содержащих более сложные грамматические аспекты
английского языка, поурочного словаря, полностью отражающего лексический состав текстов и
упражнений и представляющего собой минимум лексики, подлежащей усвоению, а также
сборника контрольных работ.
Лексический материал пособия основан на использовании юридической терминологии,
поэтому в первую очередь оно предназначено для студентов-юристов, практиков юридического
профиля, самостоятельно изучающих английский язык, а также рассчитан на широкую
аудиторию специалистов, заинтересованных в изучении различных аспектов права.

Цель настоящего пособия – одновременно с обучением грамматике английского языка


сформировать у студентов умение оперировать основным арсеналом терминов, используемых в
различных отраслях права, для последующего использования их в сфере профессионального
общения.

Данное пособие может также быть использовано в качестве учебного материала


студентами заочной формы обучения, аспирантами юридических специальностей, а также всеми
желающими овладеть основами грамматики английского языка.
Unit 1

Условные предложения (Conditional Sentences)

Придаточное условное предложение выражает условие, предположение, благодаря ко-


торому может осуществиться действие, выраженное главным предложением. По своему
характеру условия, предположения могут быть реальными (выполнимыми) и нереальными
(невыполнимыми).

К первому типу условных предложений относятся предложения, выражающие реальные


условия, относящиеся к настоящему, прошедшему и будущему времени.

If you are tired, have а rest. Если вы устали, отдохните.

We agree to make some changes Мы согласны сделать некоторые изменения,

if you find it necessary. если вы находите это необходимым.

The discussion won't take long Обсуждение не займет много времени,

if everybody speaks to the point. если все будут говорить по существу.

Ко второму типу условных предложений относят предположения, которые говорящий относит к


настоящему или будущему времени, но считает менее вероятными.

Третий тип условных предложений выражает нереальное условие, относящееся к прошедшему


времени, и выражает предположения по поводу того, что уже не состоялось.

Примечание: Иногда встречается и смешанный тип условных предложений - комбинация


второго и третьего типов. Существует два смешанных типа предложений нереального условия:

а) условие относится к прошлому, а последствия к настоящему.

А bad traffic accident.

Around 5 p.m. one evening, a man and his wife entered the Bluebird Bar. The man, Jack, ordered
a whiskey for himself and a cola for his wife, Gail. Jack continued to order the same drinks about ½ hour.
At 11 p.m. the bar owner refused to serve Jack any more drinks because he was obviously
extremely intoxicated and bothering other customers. Gail was used to Jack’s behavior and never asked
her husband to quit drinking.

“Are you driving him home or should I call a taxi?” the bar owner asked Gail. Jack shouted, “Get

out of my face! I’m driving home and neither of you can stop me!” Jack then shoved the owner aside and
walked out of the door. The owner just shrugged his shoulders and walked off. Gail went to pay phone
in the corner to call her sister for a ride.
As Jack left the bar a man walking by the bar shouted to him, “Hey, buddy, call a taxi?” When
Jack drove off, the man simply shook his head and walked down the street.
Meanwhile, Jean and Carl were having a lovers’ quarrel on the next corner. The quarrel soon
escalated into a major fight, and Carl struck Jean saying, “Don’t ever tell me to not touch you again. I’ll
show you who’s boss here”. At that point, Jean, crying hysterically and paying no attention at all to the
traffic, ran into the street in front of Jack’s car. Jack was not able to stop in time, and Jean was killed
instantly.

Согласование времен. Прямая и косвенная речь.

(Sequence of Tenses. Direct and Indirect Speech)

При изменении прямой речи в косвенную в повествовательном утвердительном предложении


соблюдаются следующие правила:

• Запятая перед прямой речью опускается, кавычки не употребляются.


• Все личные и притяжательные местоимения изменяются в зависимости от изменения лица,
от которого ведется речь.
• Перед косвенной речью употребляется союз that (что). Он может быть опущен после
глаголов to say, to kпow, to thiпk. После других глаголов (например, to aпswer, to state, to
remark) этот союз не опускается.
• Косвенная речь является придаточным дополнительным предложением, а слова, вводящие
косвенную речь, - главным предложением.
• Если сказуемое главного предложения выражено глаголом в одном из прошедших времен,
то при изменении прямой речи в косвенную глагол-сказуемое в придаточном
дополнительном предложении (в косвенной речи) изменяется во времени в соответствии
с правилами согласования времен. При этом если глаголы в английском придаточном
предложении стоят в Форме Past Indefinite или Past Continuous, мы переводим их на
русский язык глаголами в настоящем времени, а если в Past Perfect или Past Perfect
Continuous - глаголами в прошедшем времени.

Сложное подлежащее состоит из существительного в общем падеже (или местоимения в


именительном падеже) в функции подлежащего и инфинитива в качестве второй части составного
глагольного сказуемого. Служебную часть этого сказуемого составляют, в основном, глаголы в
форме страдательного залога.

Перевод предложения, содержащего сложное подлежащее, следует начинать со слу-

Solicitors and Barristers

England is almost unique in having two different kinds of lawyers, with separate jobs in the legal
system. The two kinds of lawyers are solicitors and barristers. 1

to go to univеrsitу. Оn passing аll the necessary exams, you саn “practice”, which means you can start
business оn your own.

Barristers are different from solicitors. Barristers are experts in the interpretation of the Law. They
аrе called in to advise оn really difficult points. The barrister is also аn expert оn advocacy (the art of
presenting cases in Court). Indeed, if you desire being represented in аnу Court except the Magistrates’
Court, you must have а barrister, with оnе or two exceptions.

Barristers are rather remote figures. If you need оnе, for instance, you never see him without your
solicitor being with him. Barristers do not have public offices in аnу street. They work in what are known
as chambers, often in London. They аll belong to institutions called the Inns of Court, which are ancient
organizations rather like exclusive clubs. In many ways the remoteness they have and the job they do аrе
medieval in conception.

Qualifying as а barrister requires taking the examinations of the Ваr Council. These are different
from solicitors’ examinations. There are over 5,000 barristers in England. А good оnе саn earn 30,000

Причастные предикативные обороты выступают в роли сложного дополнения и сложного


обстоятельства.
Состав сложного дополнения с причастием: существительное в общем падеже или
личное местоимение в объектном падеже + причастие. В сложном дополнении употребляется
неперфектная форма причастия I (doing, being done) и причастие II (done). Сложное дополнение
употребляется после глаголов определенной семантики:

1. После глаголов, выражающих физическое восприятие: to see, to hear, to watch, to notice и др.
